Age Assurance in 2026: From Policy Debate to Enforcement Reality

Age assurance is no longer an abstract trust-and-safety discussion. It is now an enforcement issue, a product-design issue, and increasingly a board-level compliance issue. Over the past several months, regulators, courts, and major platforms have all moved in the same direction: away from simple age gates and toward age-assurance systems that can be defended as effective, proportionate, and auditable.

That is the real shift between late 2025 and early 2026. The question is no longer whether a platform has an “Are you over 18?” popup. Regulators increasingly want to know whether the method used can actually separate adults from minors in the context that matters, whether the resulting decision can be logged and explained, and whether the platform minimized the personal data collected to get there. The FTC’s February 2026 COPPA policy statement is one of the clearest examples: it said the agency will not bring COPPA enforcement actions against certain operators that collect, use, and disclose personal information solely to determine age, provided they meet strict purpose-limitation, deletion, notice, and vendor-handling conditions.

The FTC moved from caution to conditional permission

One of the most important U.S. developments came from the FTC in February 2026. The agency issued a COPPA policy statement saying it would not prioritize enforcement where operators collect personal information strictly for age-verification purposes, use it only for that purpose, and delete it promptly afterward. It also required clear notice and careful handling by third parties.

That is not a blanket exemption, and it is not the same thing as a final new rule. But it is a major signal that federal regulators no longer want COPPA uncertainty to block stronger age-assurance adoption. In practice, it gives platforms a path to say: yes, age assurance may require data, but narrowly collected, narrowly used, promptly deleted data is different from building a permanent identity dossier.

The UK and Australia are proving this is not theoretical

The UK has already drawn a hard line on ineffective methods. Ofcom and the ICO said this week that platforms with minimum-age rules must move beyond self-declaration and use viable, highly effective age checks instead. Roblox was among the major services specifically named in the regulators’ push for stronger controls.

Australia has gone further in visible enforcement terms. Its under-16 social media ban took effect on December 10, 2025, with penalties of up to A$49.5 million for noncompliant platforms. By mid-January, regulators said roughly 4.7 million teen accounts had been removed or restricted. But more recent reporting shows the system is still imperfect: a meaningful share of Australian teens remained active on TikTok and Snapchat two months into the ban, and the new pornography and high-risk-content rules have already driven a sharp increase in VPN usage.

The point is not that the system is solved. It is that regulators are now measuring results, not just policies on paper.

Courts are reinforcing the move toward stronger checks

The Supreme Court’s June 2025 decision in Free Speech Coalition v. Paxton remains the biggest judicial turning point in the United States. It gave states a much firmer footing to require age verification for online pornography and other material-harm-to-minors contexts. Since then, the question has shifted from whether stronger age assurance is legally imaginable to where it should sit, how strong it must be, and who should bear the implementation burden.

That “where does responsibility sit?” question now extends well beyond adult content. Social media, gaming, AI companion products, app stores, and operating systems are all being pulled into the age-assurance conversation.

Roblox shows how child-safety litigation becomes age-assurance pressure

Roblox is a useful example because it sits at the intersection of youth access, platform design, and parental-reliance claims. In November 2025, Texas sued Roblox, alleging it concealed safety risks from parents; Reuters reported that Texas joined other state enforcers and many private plaintiffs who say the platform became a haven for predators and sexual exploitation. A month later, Reuters reported that nearly 80 lawsuits accusing Roblox of facilitating child sexual exploitation were centralized in San Francisco. Separately, Dutch regulators opened a probe into Roblox under the EU Digital Services Act, and UK regulators have now publicly pressed Roblox and other major platforms to enforce minimum ages with stronger checks.

Roblox’s significance is not that these cases all turn on one age-verification feature. It is that once a platform is framed as heavily youth-oriented and insufficiently protected, age assurance stops being a “nice to have” and becomes part of the expected safety stack. In other words: once the legal theory becomes “you knew minors were here, and you knew the risks,” a weak age gate starts to look like evidence, not mitigation. That is exactly why gaming and social products now belong in any serious age-assurance analysis.

Character.AI shows the commercial and regulatory cost of getting youth controls wrong

Character.AI is another important addition, because it shows that age assurance is not just about adult content anymore. Reuters reported in January 2026 that Google and Character.AI agreed to settle a Florida lawsuit alleging a chatbot contributed to a 14-year-old’s suicide, and that related lawsuits brought by parents in Colorado, New York, and Texas had also been settled. Earlier, Reuters reported that a federal judge allowed the Florida suit to proceed.

Under that pressure, Character.AI publicly announced that it would roll out age-assurance technology, combine its own model with third-party tools including Persona, and, if those tools failed, use facial recognition and ID checks. TechCrunch also reported that the company expected these changes to be unpopular and that earlier teen-protection changes had already cost it a large portion of its under-18 user base. Soon after, Character.AI moved to phase out open-ended chat for under-18 users altogether.

That is why the Character.AI episode matters. The lesson is not just “AI companion products are risky.” The sharper lesson is that once a product is accused of youth harm, companies often swing from minimal friction to aggressive gating under litigation and regulatory pressure. That is expensive, abrupt, and user-hostile. It is a strong argument for building age-aware product architecture before the crisis.

Pump.fun is not a pure age-verification case, but it still belongs in the story

Pump.fun is a weaker fit than Roblox or Character.AI if the article is strictly about age-verification law. The core Pump.fun class actions are securities and market-structure cases. But they still matter as a signal. Public versions of the complaints and coverage describe allegations that the platform did not verify who was using its services, could not distinguish adults from minors, and exposed minors to both financial risk and explicit material.

That makes Pump.fun relevant as an adjacent example of a broader pattern: age checks are increasingly being treated as part of baseline platform governance, especially where products combine addictive mechanics, money, explicit content, or vulnerable users. Even where the primary cause of action is not “failed age verification,” the absence of gating can become part of the negligence, design-defect, or foreseeable-harm story.

The technical market is changing just as fast

The technology side is moving with the law. Reuters reported this month that governments and platforms are increasingly embracing facial analysis, ID checks, and other age-assurance tools, while vendors such as Yoti, Persona, and k-ID benefit from the shift. OpenAI’s January 2026 rollout of age prediction on ChatGPT is another example of the layered model taking hold: a lighter estimation layer first, then stronger protections when a user is likely under 18.

That layered model is becoming the practical center of gravity: estimate where that is proportionate, verify where that is necessary, and keep stronger fallback methods available for higher-risk flows.

What the new reality means for platforms

Taken together, the legal and technical developments point to one conclusion: self-attestation is rapidly losing credibility for higher-risk use cases. That does not mean every platform now needs the same method. It means platforms need a risk-based age-assurance strategy.

For adult content, the pressure is toward hard verification or highly reliable age assurance. For gaming, social media, and AI companions, regulators increasingly expect age-aware experiences, stronger controls for minors, and the ability to show that youth access is not just governed by a birthdate field. For app and device ecosystems, the longer-term trend still points toward reusable age signals at the platform layer rather than repeated proofing at every destination.

The durable answer is not a checkbox and not full KYC for everyone. It is a policy-driven system that can match method to risk, minimize retained data, and produce a defensible record of what rule ran and why.
